法的效力的起止時(shí)限以及對(duì)其實(shí)施前的行為有無(wú)溯及力，即指法的時(shí)間效力。
（1）法開(kāi)始生效的時(shí)間，指法從何時(shí)起開(kāi)始發(fā)生約束力。
（2）法終止生效的時(shí)間，指法的廢止的時(shí)間。
法的溯及力，指新法頒布后對(duì)它生效前所發(fā)生的事件和行為可加以適用的效力。關(guān)于溯及力的規(guī)定大體有這樣幾種情況：一是從舊原則，即新法沒(méi)有溯及力。二是從新原則，即新法有溯及力。三是從輕原則，即比較新法與舊法，哪個(gè)處理輕些就按哪個(gè)法處理。四是從新兼從輕原則，即新法原則上溯及既往，但舊法對(duì)行為人的處罰較輕時(shí)，則從舊法。五是從舊兼從輕原則，即新法原則上不溯及既往，但新法對(duì)行為人的處罰較輕時(shí)，則從新法。
中國(guó)現(xiàn)時(shí)期主要采取從舊兼從輕原則，在特殊情況下采用溯及既往的原則。
