發(fā)布時間：2017-09-21 21:38:41一、騙取出境證件罪第三百一十九條 以勞務(wù)輸出、經(jīng)貿(mào)往來或者其他名義，弄虛作假，騙取護照、簽證等出境證件，為組織他人偷越國（邊）境使用的，處三年以下有期徒刑，并處罰金；情節(jié)嚴重的，處三年以上十年以下有期徒刑，并處罰金。單位犯前款罪的，對單位判處罰金，并對其直接負責(zé)的主管人員和其他直接責(zé)任人員，依照前款的規(guī)定處罰。1． 為組織他人偷越國(邊)境使用的 ：屬于主觀要件中目的的內(nèi)容。只要行為人出于為組織他人偷越國（邊）境的目的，騙取了護照、簽證等出境證件的，即使實際上還沒有用于組織他人偷越國（邊）境，也成立本罪。2．騙取出境證件罪的成立有兩個前提：有現(xiàn)實的或者可能的組織者，現(xiàn)實的或者可能的被組織者的行為具有偷越國（邊）境性質(zhì)。否則，不成立本罪。例如，行為人通過偽造中小學(xué)校印章、中小學(xué)生的成績單，為中小學(xué)生去國外就讀騙取簽證。這種行為只成立偽造事業(yè)單位印章罪。再如，趙某為某公司經(jīng)理，為了營利，超出經(jīng)營范圍為他人辦理簽證。趙某制作虛假公司文書，證明7名出境人員為其公司人員，并出具財產(chǎn)（擔(dān)保）證明，為7名出境人員辦理旅游簽證，使7名人員得以出境。由于持該簽證出境的行為并不構(gòu)成偷越國（邊）境，騙取出境證件的行為也不屬于 為組織他人偷越國（邊）境使用 ，所以，該行為不成立任何犯罪。3．為組織他人偷越國(邊)境使用而騙取出境證件的行為是本罪的實行行為。二、提供偽造、變造的出入境證件罪第三百二十條 為他人提供偽造、變造的護照、簽證等出入境證件，或者出售護照、簽證等出入境證件的，處五年以下有期徒刑，并處罰金；情節(jié)嚴重的，處五年以上有期徒刑，并處罰金。1．提供偽造、變造的出入境證件的行為屬于實行行為，而非幫助行為。2．行為人偽造出入境證件后又提供（包括有償提供和無償提供）給他人的，應(yīng)從一重罪處罰。注意：出售出入境證件罪沒有列入考試范圍。三、偷越國(邊)境罪第三百二十二條 違反國（邊）境管理法規(guī)，偷越國（邊）境，情節(jié)嚴重的，處一年以下有期徒刑、拘役或者管制，并處罰金。1．走私犯偷越國（邊）境的，按走私罪處理，不另認定為本罪。2．國家機關(guān)工作人員或者掌握國家秘密的國家工作人員偷越國邊（境）叛逃的，以叛逃罪論處，也不另認定為本罪。
